Terms of Service¶

These Terms of Service ("Terms") govern access to and use of the Octo Tools documentation website ("SITE") and the support and download services provided by MOKA Studio Ltda, Brazilian tax ID (CNPJ) 27.735.107/0001-34, with principal place of business in Divinópolis, MG, Brazil ("MOKA" or "we").
By accessing or using the SITE, you agree to these Terms. If you do not agree, do not use the SITE.
Note: use of the Octo Tools software itself is governed by the End-User License Agreement (EULA), not by these Terms.
1. Definitions¶

2. Acceptance¶
2.1. Use of the SITE constitutes full acceptance of these Terms.
2.2. If you access the SITE on behalf of a company, you represent that you have authority to bind that company to these Terms.
2.3. The USER must have full legal capacity. Individuals under 18 may only use the SITE under the supervision of a legal guardian.
3. Service description¶
3.1. The SITE offers, free of charge:
a) Technical documentation for the Octo Tools software; b) Tutorials and guides; c) Purchase page (checkout operated by Creem); d) Support contact channel (email).
3.2. The SITE does not provide cloud storage, user accounts, public forum registration, or Harmony scene processing.
3.3. MOKA may change, suspend, or discontinue any part of the SITE at any time, without prior notice.
4. USER obligations¶
The USER agrees to:
a) Use the SITE only for lawful purposes; b) Not attempt unauthorized access to systems, data or restricted areas; c) Not perform reverse engineering, mass scraping, denial-of-service (DDoS) attacks, code injection, or any activity that compromises the SITE's operation; d) Not use the SITE to distribute malware, spam or illegal content; e) Respect the intellectual property rights described in Section 5.
5. Intellectual property¶
5.1. All CONTENT on the SITE is owned by MOKA or its licensors and protected by copyright and other applicable laws.
5.2. Permitted use: the USER may view, print and download portions of the CONTENT for personal, non-commercial use, keeping all copyright notices intact.
5.3. Prohibited use: republishing, redistributing, translating, modifying or commercializing the CONTENT without MOKA's prior written authorization is prohibited.
5.4. Academic and journalistic citation: permitted with clear attribution (URL and project name).
5.5. Toon Boom Harmony® is a registered trademark of Toon Boom Animation Inc. Octo Tools is not affiliated with, sponsored by or endorsed by Toon Boom Animation Inc.
6. Privacy¶
The processing of personal data arising from use of the SITE is governed by the Privacy Policy, which forms an integral part of these Terms.
7. External links¶
7.1. The SITE may contain links to third-party sites (Creem, GitHub, Toon Boom, social media, etc.).
7.2. MOKA does not control, endorse or accept responsibility for the content, policies or practices of those sites. Access is at the USER's own risk.
8. Disclaimer of warranties¶
8.1. THE SITE IS PROVIDED "AS IS", WITHOUT WARRANTY OF UNINTERRUPTED AVAILABILITY, ABSENCE OF ERRORS, ABSOLUTE SECURITY OR CURRENCY OF THE CONTENT.
8.2. MOKA uses reasonable efforts to keep the SITE online, but does not guarantee uptime, performance, or compatibility with any specific browser, device or assistive technology.
8.3. The documentation reflects MOKA's best understanding at the time of publication, but may contain inaccuracies. The USER should validate critical information before production use.
9. Limitation of liability¶
9.1. To the maximum extent permitted by law, MOKA shall not be liable for indirect, consequential damages, lost profits, loss of data or business interruption arising from the use or inability to use the SITE.
9.2. The limitations in this Section do not apply to damages resulting from willful misconduct or gross negligence by MOKA, nor do they waive consumer rights under the Brazilian Consumer Protection Code.
10. Amendments to these Terms¶
10.1. MOKA may update these Terms at any time.
10.2. Material changes will be flagged in the SITE footer or on a visible notice page for at least 30 days.
10.3. Continued use of the SITE after the effective date constitutes acceptance.
11. Suspension and blocking¶
MOKA may block access for any USER who breaches these Terms, without prior notice, without prejudice to applicable legal action.
12. Governing law and jurisdiction¶
12.1. These Terms are governed by the laws of Brazil.
12.2. The courts of Divinópolis, Minas Gerais, Brazil are designated as exclusive forum for any disputes, the parties waiving any other forum however privileged.
13. General provisions¶
13.1. If any clause of these Terms is held invalid, the remaining clauses shall continue in full force.
13.2. MOKA's tolerance of any breach does not constitute a waiver of its rights.
13.3. These Terms, together with the EULA and the Privacy Policy, constitute the entire agreement between the parties regarding the SITE.
